Terms of Service

1. Acceptance of terms

By accessing or using the MaritimeCast platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Amaqhawe SA Technologies (Pty) Ltd ("MaritimeCast", "we", "us", "our"), a company registered in South Africa.

2. Description of service

MaritimeCast is a two-sided maritime crew identity and recruitment platform that:

  • Allows seafarers to create verified professional identity profiles
  • Allows verified recruiters to discover and contact maritime talent
  • Provides a jobs board for maritime entertainment, hotel, and catering positions
  • Facilitates contact requests between recruiters and seafarers

MaritimeCast is not a recruitment agency. We do not guarantee employment, place candidates in roles, or take commission on placements. We provide the platform infrastructure only.

3. Eligibility

To use MaritimeCast you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable law
  • Provide accurate and truthful information during registration

4. User accounts

4.1 Registration

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Account security

You are responsible for all activity that occurs under your account. Notify us immediately at support@crewdeck.com if you suspect unauthorised access to your account.

4.3 One account per person

Each individual may maintain only one seafarer account. Recruiters may maintain one account per company, with team members added under that account where the plan permits.

4.4 Account suspension

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

5. Seafarer responsibilities

As a seafarer on MaritimeCast, you agree to:

5.1 Accuracy of information

Provide accurate and truthful information about your qualifications, experience, and documents. Uploading false or fraudulent certificates is a serious violation that will result in immediate account termination and may be reported to relevant maritime authorities.

5.2 Document authenticity

You confirm that all documents you upload are genuine, current, and belong to you. MaritimeCast does not independently verify documents but reserves the right to do so.

5.3 Profile maintenance

Keep your profile up to date, particularly availability status and certificate expiry dates. Recruiters rely on this information to make hiring decisions.

5.4 Professional conduct

Communicate professionally with recruiters. Do not use the platform to solicit payments, engage in fraudulent activity, or harass other users.

5.5 Visibility control

You are solely responsible for managing your profile visibility. Setting your profile to Visible means verified recruiters can find and contact you.

6. Recruiter responsibilities

As a recruiter on MaritimeCast, you agree to:

6.1 Company verification

Provide accurate company information during registration. Misrepresenting your company or credentials will result in immediate account termination.

6.2 Legitimate use only

Use the platform solely for legitimate maritime crew recruitment purposes. You may not use MaritimeCast to:

  • Harvest seafarer data for purposes other than direct recruitment
  • Send unsolicited commercial messages
  • Approach seafarers for roles that do not exist
  • Collect or store seafarer personal data beyond the contact details shared upon acceptance

6.3 Data protection

You agree to handle seafarer contact details received through MaritimeCast in compliance with applicable data protection laws, including POPIA. You may use contact details only for the specific recruitment purpose for which they were shared.

6.4 Contact request conduct

Contact requests must be genuine, role-specific, and professional. Sending contact requests without genuine recruitment intent is a violation of these Terms.

6.5 Vacancy accuracy

All vacancies posted must be genuine and accurately described. Posting fake vacancies to collect applicant data is strictly prohibited.

7. Prohibited conduct

All users agree not to:

  • Impersonate any person or entity
  • Upload malicious code or attempt to compromise platform security
  • Attempt to access other users' accounts or private data
  • Scrape, crawl, or systematically extract data from the platform
  • Use the platform for any unlawful purpose
  • Interfere with the proper functioning of the platform
  • Circumvent any access controls or security measures

Violations may result in immediate account termination and legal action where appropriate.

8. Intellectual property

8.1 MaritimeCast content

The MaritimeCast platform, including its design, code, trademarks, and content created by us, is owned by Amaqhawe SA Technologies (Pty) Ltd. You may not copy, reproduce, or distribute any part of the platform without our written permission.

8.2 Your content

You retain ownership of the content you upload to MaritimeCast (profile information, documents, photographs). By uploading content, you grant MaritimeCast a limited licence to store, display, and process that content solely for the purpose of operating the Service.

9. Subscription and payments

9.1 Seafarer plans

The basic MaritimeCast profile is free for all seafarers. The optional Visible Pro plan ($4.99/month or $39/year) provides enhanced visibility features.

9.2 Recruiter plans

Recruiter subscriptions are available at the following tiers:

  • Starter: $49/month or $470/year
  • Professional: $149/month or $1,430/year
  • Agency Pro: $299/month or $2,870/year

9.3 Free trial

New recruiter accounts receive a 14-day free trial of the Professional plan. No payment method is required during the trial. At the end of the trial, the account downgrades to the Starter plan unless a subscription is purchased.

9.4 Payment processing

All payments are processed by Paddle, who acts as merchant of record. Paddle handles all tax collection and compliance on our behalf. By subscribing, you also agree to Paddle's terms of service.

9.5 Billing

Subscriptions are billed in advance on a monthly or annual basis. All prices are in USD.

9.6 Price changes

We reserve the right to change subscription prices with 30 days notice. Existing subscribers will be notified by email.

10. Cancellation and refunds

10.1 Cancellation

You may cancel your subscription at any time via Settings → Billing → Manage Billing. Cancellation takes effect at the end of the current billing period. You retain full access until that date.

10.2 Downgrade on cancellation

On cancellation, recruiter accounts downgrade to the free tier. All your data (saved talent, notes, vacancy history) is preserved but subject to free tier limits.

10.3 Refunds

We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact support@crewdeck.com within 14 days of the charge.

10.4 Account deletion

Deleting your account cancels any active subscription immediately. No refund is provided for the remaining subscription period.

11. Disclaimers

11.1 No employment guarantee

MaritimeCast makes no guarantee that seafarers will receive contact requests or secure employment, or that recruiters will find suitable candidates.

11.2 Platform availability

We aim for high availability but do not guarantee uninterrupted access to the platform. Scheduled maintenance will be communicated in advance where possible.

11.3 Third party links

The platform may contain links to third-party websites. We are not responsible for the content or practices of those websites.

11.4 Document verification

MaritimeCast displays document status as provided by seafarers. We do not independently verify the authenticity of uploaded documents. Recruiters should conduct their own due diligence.

12. Limitation of liability

To the maximum extent permitted by South African law, MaritimeCast shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of employment opportunities or revenue
  • Reliance on information provided by other users
  • Data breaches caused by user negligence (e.g. sharing login credentials)

Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to MaritimeCast in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Amaqhawe SA Technologies (Pty) Ltd, its directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of the platform
  • Content you upload or transmit
  • Your violation of any third party rights

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the South African courts.

We encourage you to contact us at support@crewdeck.com before initiating any formal dispute process. We are committed to resolving issues fairly and promptly.

15. Changes to terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before changes take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MaritimeCast regarding your use of the platform.
